1. Agreement to These Terms

These Terms of Service govern your use of LumaTutor, an online reading, writing, and study practice service operated by RYANELLA INC..

By creating an account, using LumaTutor, creating a student profile, purchasing credits, starting a subscription, or allowing a student to use the service, you agree to these Terms and our Privacy Policy. If you create a student profile, you also agree to our Children's Privacy Notice.

2. Service Description

LumaTutor provides online educational practice tools that may include reading practice, writing practice, level tests, AI-generated feedback, scoring support, saved vocabulary, notes, parent dashboards, progress reports, and related account tools.

The service is for lawful educational use only. We may change, add, limit, or remove features as the product evolves.

3. Parent or Guardian Account Holder

A parent or legal guardian must create and manage the family account and student profiles.

The parent account holder is responsible for billing, credits, student profiles, student login credentials, supervision of student use, and ensuring that use of LumaTutor complies with these Terms.

By creating a student profile, you confirm that you are the student's parent or legal guardian, or that you have authority to provide consent for the student's use of the service.

4. Student Accounts

Students sign in with a student code and PIN created or managed by the parent account holder. Students do not create independent public accounts.

Parents should keep student codes and PINs secure and should not share them outside the family or an authorized learning setting.

Student accounts may be disabled, reset, or deleted by the parent account holder or by LumaTutor when needed for security, policy, legal, or operational reasons.

5. AI Tutoring and Educational Results

LumaTutor uses AI systems to provide feedback, hints, scoring support, writing review, vocabulary explanations, and safety checks.

AI feedback and scores are educational guidance only. They are not a guarantee of school grades, standardized test scores, admissions outcomes, academic improvement, or any specific result.

AI output may be incomplete, incorrect, delayed, or unavailable. Parents and students should review important work independently and should not rely on LumaTutor as the sole source of instruction or assessment.

LumaTutor is not an emergency service, crisis hotline, medical service, mental health service, legal service, or professional counseling service.

6. Credits

LumaTutor uses credits for eligible tutoring and practice features. Credit costs may vary by feature or session type and are shown in the product when practical.

Reading and writing practice sessions currently use a fixed credit cost. Goal time affects pacing and timer display, not the credit charge.

Credits added by purchase, subscription grant, admin grant, signup grant, restored lesson credit, or another credit grant expire 12 months after they are added unless we state otherwise in writing.

Credits are not cash, are not stored value, are not transferable outside LumaTutor, and may be used only within LumaTutor.

7. Credit Charges and Restored Credits

Credits may be charged when a tutoring session starts or when a paid feature is used.

If a session fails because of a confirmed LumaTutor system, billing, or tutor-service issue, we may restore credits after review.

Credits are not restored for ordinary student inactivity, closing the browser, device issues, network issues outside our control, skipped work, or incomplete work unless we determine that a service issue caused the failure.

8. Subscriptions and Automatic Renewal

Subscription plans renew monthly and your saved payment method will be charged each month at the then-current plan price, plus applicable taxes if any, unless you cancel renewal before the next renewal date. Plan prices are listed before applicable taxes unless checkout states otherwise.

Payment processing is handled by Stripe. LumaTutor does not store full card numbers.

You can cancel renewal online from the billing tools in your parent account. You may also contact support if you cannot access your account tools. Cancellation stops future renewals at the end of the current paid period but does not automatically refund prior payments, partially used periods, used credits, expired credits, bonus credits, or admin-granted credits.

You are responsible for canceling before the renewal date if you do not want the next charge. Deleting or disabling a student profile, stopping use, closing a browser, or not using credits does not automatically cancel renewal.

If you upgrade, downgrade, cancel, or change a plan, credit grants, student limits, billing timing, and proration may be handled according to the plan rules shown in the product or by Stripe checkout.

9. Refund Policy

Refund requests for credit purchases or subscription payments are reviewed only within 30 days of the payment date.

Payments older than 30 days are not refundable, except where required by law.

Used credits, expired credits, signup credits, admin-granted credits, restored credits, and partially used subscription periods are not refundable unless required by law or approved by LumaTutor after review.

Approved refunds may result in removal of related credits, reversal of unused purchased credits, suspension of disputed access, or adjustment of account access. If related credits have already been used or expired, we may deny the refund, reduce the refund, or require manual review unless law requires otherwise.

10. Acceptable Use

You may not disrupt the service, attempt to access another user's account, misuse student login credentials, bypass access controls, reverse engineer the service, scrape or copy protected content at scale, submit harmful or unlawful content, interfere with tutor safety features, or use automated tools to overload the system.

You may not use LumaTutor to violate privacy rights, intellectual property rights, school rules, payment rules, or applicable law.

We may pause, suspend, limit, or terminate access when needed to protect students, users, payment integrity, service security, content rights, or legal compliance.

11. Content and Learning Materials

LumaTutor may provide original passages, questions, prompts, explanations, feedback, reports, and other learning materials. Those materials are owned by LumaTutor or its licensors and may be used only through the service for personal educational use.

Parents and students may submit answers, writing, notes, highlights, saved words, and other learning content. You grant LumaTutor permission to use that content to provide, secure, evaluate, support, and improve the service, consistent with our Privacy Policy and Children's Privacy Notice.

Do not submit content you do not have the right to use.

12. Privacy and Student Data

Our collection and use of personal information is described in our Privacy Policy. Child-specific practices are described in our Children's Privacy Notice.

Parents are responsible for providing accurate consent and for managing student profiles in a way that is appropriate for their family or authorized learning setting.

Parents may request access, correction, export, deletion, or de-identification of child information by using account tools or contacting support. We may verify identity and authority before acting and may retain limited records where reasonably necessary for billing, security, dispute resolution, legal compliance, backups, or audit integrity.

13. Service Availability and Changes

We work to keep LumaTutor reliable, but the service may be unavailable during maintenance, provider outages, network issues, security events, or unexpected incidents.

We may change features, prices, plans, credit policies, supported modes, model providers, content libraries, and account tools as the product evolves. We will communicate material changes when required by law or when practical.

14. Account Suspension or Termination

We may suspend or terminate accounts for policy violations, payment issues, chargebacks, fraud risk, security concerns, abuse, legal requirements, or conduct that may harm students, users, LumaTutor, or service providers.

You may request account help or account closure by contacting support. Account closure does not automatically cancel an active subscription unless cancellation is completed through the billing tools or confirmed by support, and it does not remove records we must retain for lawful, billing, security, tax, dispute, or audit reasons.

15. Disclaimers

To the fullest extent permitted by law, LumaTutor is provided on an as-is and as-available basis without warranties of uninterrupted availability, error-free operation, specific educational outcomes, or compatibility with every device, browser, school requirement, or curriculum.

Nothing in these Terms limits rights that cannot be limited under applicable law.

16. Limitation of Liability

To the fullest extent permitted by law, LumaTutor and RYANELLA INC. are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or educational opportunity.

To the fullest extent permitted by law, our total liability for claims related to the service is limited to the amount you paid to LumaTutor for the service giving rise to the claim during the three months before the claim arose.

17. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, except where applicable law requires otherwise.

18. Changes to These Terms

We may update these Terms as LumaTutor changes. If we make material changes, we will update the date above and provide additional notice when required by law or when practical for the change.

Continued use of LumaTutor after updated Terms become effective means you accept the updated Terms.
